This is an often debated topic. Though the laws may vary city to city, in Toronto the laws are very clear. Toronto bed bug problems are the landlord’s responsibility.
What does this mean if you’re a tenant?
If you discover symptoms of bed bugs in your apartment or unit, you’re obligated to report it to your landlord. Some tenants are embarrassed by the fact that they brought home the pests and attempt to treat bed bugs themselves. This can put the entire building in jeopardy. The critters can and do migrate from unit to unit to escape bed bug extermination. Reporting any incidents of bed bugs allows your landlord to address the problem on a larger-scale, taking into account how the situation will affect your neighbours and common areas. If you report an incident of bed bugs to your landlord, it is their legal obligation to find and hire a licensed bed bug extermination company to do an inspection, and if bed bugs are discovered, pay the costs associated with bed bug removal, however you must cooperate with their efforts. Landlords are required to give you 24 hours notice and schedule the treatments to get rid of bed bugs between 8am and 8pm. You may schedule other times if you come to an agreement with your landlord, however.
If you discover an issue and your landlord refuses to assist you in getting rid of bed bugs, the law is on your side. You may try contacting Toronto’s health department for assistance with the issue or try filing a civil suit. Toronto Public Health may issue a protection order that demands your landlord take action if your situation fits the requirements.
What does this mean if you’re a landlord?
As a landlord, the city of Toronto deems it your responsibility to get rid of bed bugs in any of your units, regardless of how they got there. Whether that means treating a single unit, or the entire building, it is at your discretion. However, if a tenant reports a bed bug sighting, you should immediately hire a bed bug extermination company to do an inspection. The quicker you handle the problem, the less likely it is to spread to other units, therefore keeping costs down.
